A licensed provider evaluates your condition and determines clinical appropriateness for Texas in accordance with applicable guidelines.

Evaluations in Texas are conducted by licensed professionals in accordance with federal housing guidance. Documentation is issued only when medically appropriate.

Special circumstances.

  • The Texas Fair Housing Act (Tex. Prop. Code Ch. 301) mirrors the federal FHA. Federal HUD guidance controls how landlords evaluate ESA requests.
  • HB 4164 (2023, eff. 9/1/2023): misrepresenting an animal as a service animal is a Class B misdemeanor -- up to $2,000 and/or 180 days in county jail, plus 30 hours of community service for a disability-serving organization.
  • ESAs do not have public-accommodation access rights in Texas.
