Evaluations in New York are conducted by licensed professionals in accordance with federal housing guidance. Documentation is issued only when medically appropriate.
Special circumstances.
- →NYS Human Rights Law (Exec. Law 296) and NYC Human Rights Law (Admin. Code 8-107) reach more landlords than federal FHA -- particularly in New York City.
- →A 2020 amendment codifies that refusing to allow an animal as a reasonable accommodation to alleviate symptoms is unlawful.
- →Affixing a false service / guide / hearing / therapy-dog ID is unlawful (NY Ag & Mkts Law 118): escalating fines or up to 15 days. A pending bill (S5435) would raise penalties.
- →ESAs do not have public-accommodation access rights in New York (Civ. Rights Law 47 covers service animals only).
