Special circumstances.

  • MGL c. 151B 4 protects against disability discrimination in housing and reaches certain small landlords that federal FHA does not (e.g., 3-4 unit owner-occupied buildings).
  • Owner-occupied 2-family dwellings are exempt from these state housing protections.
  • Massachusetts has no ESA-specific misrepresentation statute. General federal and state law applies.
  • ESAs do not have public-accommodation access rights in Massachusetts.
